RESOLUTION No.1-LHE/7-CONF
ON
PUIC-OIC COOPERATION ON THE IMPLEMENTATION OF THE
TEN-YEAR PROGRAMME OF ACTION
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30-31 January, 2012,
Referring to the Resolutions of the Third Extraordinary Islamic Summit Conference, held in Makkah Al-Mukarammah, on 7 – 8 December 2005 concerning the adoption of the Ten-Year Programme of Action,
Recalling the Provisions of the Final Declaration of the 5th Session of the PUIC Conference, held in Cairo, on 30-31 January 2008, concerning the same subject;
Putting before its eyes the growing challenges which face the true image of Islam, and the common interests of the Islamic Ummah, in a world where the rate of interlinking, complexity and globalization is increasing, which necessitates strengthening future cooperation and coordination among OIC Member States;
Seeking to take steps to promote Islamic Solidarity, unify the word of Muslims as well as project the true image of Islam and its tolerant values and civilizational methodologies;
1. Welcomes this important cooperation and requests continuation of cooperation with the OIC in implementing the Ten-Year Programme of Action in the various fields.
- In the ideological and political fields there are issues concerning consolidation of the values of moderation, tolerance, fighting against extremism, violence, combating terrorism, countering the phenomenon of Islamophbia; as well as achieving solidarity and cooperation among Muslims States and preventing disputes between them; Palestine Cause; rights of Muslim groups and communities; and rejection of unilateral sanctions. All such issues necessitate renewed commitments to address them through the adoption of effective strategies. In this respect it is imperative to pay special attention to Africa which is part of the world mostly afflicted by poverty, diseases, illiteracy, famine and indebtedness.
- In the economic and scientific domains the Ummah ought to achieve higher standard of development and prosperity in view of the huge economic and energy resources possessed by the Muslim World. Priority must be given to promote economic cooperation, intra-trade, and poverty alleviation in the OIC States, especially in areas affected by conflicts. We must also tackle issues concerning globalization, economic liberalization, environment, science and technology.
- As regards education and culture, there is an urgent need for addressing the rampant illiteracy, the low standard of education at different levels and correction of the ideological deviations.
- In the social field, attention must be paid to true rights of women, children and the family.
2. OIC role in implementing such visions and objectives for the Islamic World is a central role which necessitates reforming the OIC in order to enable it to fulfill the hopes and aspirations of the Ummah in the Twenty-first century.
3. Requests the PUIC Secretary General to follow-up the implementation of this resolution and report to the next PUIC Conference.
RESOLUTION No.2-LHE/7-CONF
ON
SIGNING/RATIFICATION OF (ACCESSION TO) THE CHARTER AND THE AGREEMENTS CONCLUDED UNDER THE ORGANIZATION OF THE ISLAMIC COOPERATION
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30-31 January, 2012,
Having considered the signing, ratification and accession status of the agreements concluded under the Organization of the Islamic Cooperation,
Noting that the minimum number of ratifications by Member States required for the entry into force of some of these agreements has not been reached as required by their provisions, and the importance of accelerating the ratification in order to support the role of the OIC and widen the scope of cooperation among Member States,
1. Urges Member Parliaments to sign, ratify or accede to, as soon as possible, the various agreements concluded within the framework of the Organization of the Islamic Cooperation.
2. Requests the PUIC Secretary General to follow up this resolution and to report thereon to the next Session of the PUIC Conference.
RESOLUTION No.3-LHE/7-CONF
ON
COOPERATION WITH THE UNITED NATIONS
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30-31 January, 2012,
Recalling the directives of the Heads of State and Governments at the OIC Summit Conference in Lahore that Member States of the OIC should coordinate their positions at the U.N and other international Organizations;
Considering that such coordination of policy can be made more effective and organized if the Union obtains Observer status with the United Nations as well as if Member Parliaments make it a practice to hold periodic consultations in international forums on important political and economic matters;
1. Decides to seek Observer status for the Union (PUIC) with the United Nations and requests Member Parliaments to propose the inclusion of an item to this effect at the forthcoming Session of the U.N General Assembly.
2. Requests the Member Parliaments to urge their respective governments to direct their Permanent Mission to the UN to support the application and the Resolution of the PUIC General Secretariat at the UN General Assembly for observer status.
3. Authorizes the Secretary General to request the present President of the PUIC Conference to apply on behalf of the PUIC, to the UN General Assembly for observer Status at the UN.
4. Also Authorizes the Secretary General to ensure the participation of the Islamic Parliamentary Union of the OIC Member States (PUIC) in the relevant Conferences held under U.N auspices.
5. Requests Member Parliaments of the PUIC to organize consultations at the U.N and other international organizations, as and when necessary on important political, and economic matters.
RESOLUTION No.4-LHE/7-CONF
ON
DEMOCRACY AND HUMAN RIGHTS
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30-31 January, 2012,
Guided by the noble teachings of Islam which enjoin the Muslim peoples to safeguard the bounties that Allah has granted them on earth,
Recalling all relevant Draft Resolutions adopted by the Islamic Summits and Islamic Conferences of Foreign Ministers, especially Draft Resolution NO.19/40-P concerning the Cairo Declaration on Human Rights;
Being aware of the universality and nature of Islamic values which are indivisible as regards human rights, the outstanding position of Man in Islam, considered as God’s vicegerent on Earth, and consequently of the importance accorded by Islamic thought to strengthening, encouraging and respecting human rights;
Convinced that there is an urgent need for further exploring ways and means to strengthen and protect human rights;
Expressing its concern over the attempts to exploit the issue of human rights to throw doubt on the principles and fundamentals of Islamic Sharia and interfere in the internal affairs of Muslim States, and condemns discrimination in addressing issues on human rights;
Stressing the utmost importance of national, regional, cultural and religious specificities in defining rules and criteria relating to human rights;
Considering that education in the exercise of democracy and that the popularization of human rights in compliance with Islamic legislation are part and parcel of the right to education and training, both being the tool for society and the nation to prepare good citizens and empower them for future leadership;
Emphasizing that awareness of the people of their rights is considered as one of their natural rights based on their right to education provided for by international conventions, based on the belief, culture and needs of the nation in such a way as to achieve harmonization of thought, objective, methodology and the means to ensure the respect of human rights and protect the freedom of thought and expression and the effective participation of citizens in building society all in compliance with the precepts of the Islamic Sharia’a;
1. Recommends PUIC Members Parliaments the necessity of teaching a special course on human rights and democratic principles in light of the Islamic shari’a,
1.1 Urges the protection of the culture of human rights and respect for its universal values, while recognizing the right of every human being to the preservation of the specific features of his cultural identity;
1.2 Gives attention to the principles upon which the culture of human rights is based and rejection of the domination of one cultural model over the rest;
2. Affirms the need to, where appropriate, amend national laws, systems and legislations to achieve democracy and protect human rights and freedom of opinion and expression in accordance with the provisions of the Islamic shari’a;
3. Strongly rejects and condemns politicization, selectivity and discrimination in addressing issues related to human rights at the regional and international levels;
4. Expresses its deep concern over the repeated and widespread association of Islam and Moslems with terrorism and violation of human rights, which has led to the intensification of Islamphobia as well as the increase of prejudice and discrimination against Moslems in all parts of the world.
5. Stresses the responsibility of all governments to ensure total respect for Islam and other divine religions and to prohibit the media from taking the freedom of expression as an excuse to defame these religions.
6. Calls on all member Parliaments to carry out their obligations in giving top priority to human rights.
RESOLUTION No.5-LHE/7-CONF
ON
ENVIRONMENTAL PROTECTION AND SUSTAINABLE DEVELOPMENT
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30-31 January, 2012,
Noting that the environment is the world’s life support system and must be conserved in order to maintain all forms of life;
Recognizing that the adverse effects of climate change are already evident and widespread, particularly in developing countries;
Recognizing also that the abundant resources in the world are an invaluable inheritance for future generations and therefore should be used wisely;
Mindful that the United Nations Conference on Sustainable Development (Rio+20 Summit) will be held in Rio de Janeiro, Brazil, in 2012, and that the PUIC Member States will need to enhance its cooperation in the sustainable development issues to ensure the readiness and effective participation of the Islamic countries;
Inspired by the Islamic teachings that guide humankind on how to manage the earth and use all the resources of the earth for the good of present and future generations;
Reaffirming the commitment to enable the full, effective and sustained implementation of the United Nations Convention on Climate Change, through long-term cooperative action, now, up to and beyond 2012, based on the Bali Roadmap, Bali Action Plan and Cancun Agreements;
Recalling the Tunis Declaration on Enhancing the Efforts of the Islamic World towards Environment Protection and Sustainable Development as issued by the Fourth Islamic Conference of Environment Ministers held in Tunis, Republic of Tunisia, in 2010;
Welcoming the adoption by COP-17/CMP-7 UNFCCC in Durban, South Africa of the decisions regarding the second commitment period of the Kyoto Protocol; the extension of the Ad-hoc Working Group on Long-term Cooperative Action under the Convention to continue its work and reach the agreed outcome pursuant to the Bali Action Plan; as well as the establishment of the Ad-hoc Working Group on the Durban Platform for Enhanced Action to undertake a process to establish a future regime of climate change, to be concluded by 2015:
1. Calls the Parliaments of the PUIC Member States to requests their respective governments to formulate a comprehensive sustainable development policy which aims for enhancing sustainable economic growth, social condition improvement and environmental protection;
2. Requests the State of the PUIC Member Parliaments to strengthen policy coordination and take concerted actions among the Muslim States, toward stronger, more sustainable and balanced growth, based on the framework of Islamic solidarity;
3. Supports the active and effective participation of the States of PUIC Member Parliaments in the preparatory process of the Conference on Sustainable Development in June 2012;
4. Further supports the outcomes of the 17th United Nations Climate Change Conference held in Durban in December 2011, particularly in relation to maintaining the continuation of the Kyoto Protocol;
5. Encourages the States of PUIC Member Parliaments to actively engage, in various international forums in promoting international cooperation on environmental protection and sustainable use of natural resources;
6. Further encourages the State of the PUIC Member Parliaments to promote effective participation of relevant stakeholders at the regional, national and local level in strengthening legislations in order to implement adaptation and mitigation programmes and activities in the Islamic countries;
7. Invites the PUIC Member Parliaments through their respective legislative mechanism to monitor the implementation of actions taken by their governments to cope with the climate change challenges for the benefit of present and future generations.
8. Encourages developed countries to share their technological know-how in the field of renewable technology.
9. Urges international community to play a role by creating a special fund to overcome financial consideration especially for the poor countries.
RESOLUTION No.6-LHE/7-CONF
ON
ESTABLISHING LEGAL FRAMEWORK FOR THE PROTECTION OF THE RIGHTS OF MIGRANT WORKERS
The Conference of the Parliamentary Union of the OIC Member States, in its 7th Session, held in Palembang, Republic of Indonesia on 7 – 8 Rabi ul Awwal, 1433 corresponding to 30 - 31 January, 2012,
Recalling on the Cairo Declaration on Human Rights in Islam, the International Labour Organization conventions, and core international human rights treaties, particularly the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, the International Covenant on Civil and Political Rights, the International Covenant on Economic, Social and Cultural Rights, the Convention on the Elimination of All Forms of Discrimination against Women, the Convention on the Rights of the Child, the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment,, and UN General Assembly Resolution on improving the coordination of efforts against trafficking in persons;
Recalling to the Resolution on the Protection of the Rights of Migrant Workers and Members of Their Families adopted at 13th Session of the Council of the PUIC in Abu Dhabi, State of the United Arab Emirates on 13 Safar, 1432 H corresponding to 18 January 2011;
Underlining the significant economic, social and cultural contribution of migrant workers to both state of origin and state of employment of the OIC and to the development of prosperity of the Ummah;
Being alarmed by the rising number of irregular migrant workers, fuelled by the growth of informal employment, shortages of workers for dirty, demeaning and dangerous (“3Djobs”) and lack of opportunities for regular labor migration;
Reaffirming that migrant workers and their families, particularly the children of irregular migrants, are vulnerable group whose human rights require protection;
Deeply concerned with the abuse, discrimination and violation of the rights of the migrant workers, in particular women migrant workers, and members of their families;
Considering that many serious problems are faced by migrant workers and members of their families and the lack of legal instrument and legal protection provided by both the State of origin and the State of employment could lead migrant workers to a more vulnerable situation;
Welcoming the progress made on the implementation of OIC Plan of Action in Advancing of Women and pledges to support the Mechanism for the Implementation of the OIC Plan of Action for the Advancement of Women.
Recognizing the important role of parliament as Nobile official of people representatives, in strengthening social and human rights policies as well as providing legal protection on migrant workers to assert human rights and to affirm the right to dignified life in accordance with the Islamic values;
Bearing in mind the importance of friendly relationship and cooperation among governments, parliaments as well as people of States of the PUIC Member Parliaments in solving the problems relating to migrant workers:
1. Calls upon the PUIC Member Parliaments to enhance and develop legal framework by promoting comprehensive legislative, administrative and other necessary parliamentary measures to enhance the protection of the rights of migrant workers, including the promotion of fair and appropriate employment protection, payment of wages, access to decent working and living conditions and other assistances to migrant workers, especially Muslim migrant workers;
2. Calls on the PUIC Member Parliaments to incorporate provisions of conventions made at the global and regional level into national legislations to end exploitation of and violence against migrant workers, particularly women;
3. Urges PUIC Member Parliaments to encourage their executive counterparts to provide access to legal and judicial system as well as resources and remedies to migrant workers who become the victims of human rights violation, including discrimination, low paying and low status of jobs;
4. Encourages the PUIC member Parliaments of both the State of origin and the State of employment to ensure that their national regulations have stipulated the protection of migrant workers’ rights to resort to justice and to be enforced based on the principle of equality-before-the law, to all individuals and without discrimination between migrant workers and citizens;
5. Requests the State of origin to provide migrant workers with adequate skills and knowledge in order to be able to fulfill their task and understand the culture, prevailing laws and regulation in the state of employment;
6. Urges the PUIC Member Parliaments to promote concrete bilateral, regional and multilateral cooperation including Colombo Process and Abu Dhabi Process in addressing different aspects of migrant workers such as admission procedures, flows of migrant, social and economic security, family reunification possibilities, integration policy and return;
7. Encourages the PUIC Member Parliaments, in particular those of the states of origin and employment, to share information on violence against migrant workers and to recommend concrete measures and actions to address the problems.
8. Calls upon the PUIC Member Parliaments to develop and provide strong national legislation to fulfill the OIC Member-State's obligation to exercise due diligence to prevent violence against women and girls, provide protection to the victims and investigate, prosecute and punish the perpetrators of violence against women and girls.
9. Supports the full realization of OIC Plan of Action in Advancing of Women and urges the respective government to disseminate to the public the Mechanism for the Implementation of the OIC Plan of Action for the Advancement of Women;
10. Encouraging further the PUIC Member parliaments to urge their respective governments to support the global efforts in achieving universal ratification of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, and ensures that no reservation is incompatible with the object and purpose of the Convention.
11. Calls upon the PUIC Member Parliaments to propose to their respective countries a comprehensive legal framework of anti-human trafficking law to encounter the influx of illegal migrant workers.
