RESOLUTION No.1-PE/13-CNCL
ON
THE SITUATION IN PALESTINE

The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Proceeding from the principles and objectives enshrined in the PUIC Statute and the OIC Charter,

Pursuant to the Islamic resolutions on the cause of Palestine,

Recalling the resolutions adopted by the UN General Assembly and Security Council concerning the Palestinian issue,

Referring to the resolutions adopted by the UN Human Rights Council relating to the violations of human rights in occupied Arab Palestinian territories

Proceeding from the resolutions adopted by the First Extraordinary Open-ended Meeting of the PUIC Conference, at the level of Parliament Speakers, held in Damascus, Syrian Arab Republic on   30 June, 2010.

Stressing that the Israeli expansionist policies, practices and plans do not only imperil Arab States and the peace process, but also threaten Muslim States and endanger international peace and security;

1.    Strongly condemns the continuing Israeli aggressions against the Palestinian people, especially in Gaza Strip, considered as a blatant violation of the International Law, and the International Humanitarian Law and constitute war crimes and crimes against humanity; and calls for prosecuting the perpetrators of these crimes to realize international justice.

2.    Confirms the recognition by the States of the PUIC Member Parliaments of the independent State of Palestine, with the borders of the territories occupied after the 4th of June, 1967, with the city of Al Quds Al Sharif as its capital and requests that this recognition be immediately applied by the OIC Member States, and that the upgrade the level of relations with the State of Palestine to the level of “Embassy”

3.    Requests the international community and all the States of the world to recognize the independent State of Palestine, also requests the UN Security Council to adopt a resolution recognizing the independent Palestinian State with the borders of the territories occupied after the 4th of June, 1967 with City of Al Quds Al Sharif as its capital.

4.    Hails the steadfastness of the Palestinian people in confronting the Israeli aggression and the unjust blockade imposed on the Palestinians, especially in the Gaza Strip. Reiterates its support to the legitimate struggle of the Palestinian people for restoring their national, legitimate, inalienable and original rights, including the right to self-determination, the establishment of an independent State with Al Quds Al Sharif as its capital and solving the issue of the Palestinian refugees in accordance with the UN General Assembly Resolution 194, of 1948.

5.    Demands total lifting of the land, sea and air blockade of Gaza Strip aimed at ending the suffering of its people imposed on it for more than three years, which constitutes collective punishment of more than 1.5 million Gazans.

6.    Mandates the General Secretariat with following up the issue of visiting Gaza by Parliament Speakers in implementation of the Resolution of the First Extraordinary Conference, held in Damascus on 30 June, 2010.

7.    Strongly demands the Israeli occupation authorities to pay financial reparations to the families of the martyrs as well as to those injured during the aggression on Gaza in December 2008. Other financial reparations are also to be paid for demolishing Palestinian houses, properties as well as public and private, civilian and government institutions in Gaza, in implementation of international laws, in reparation for the destruction of UN institutions during that cruel aggression. It also requests the international community to exert pressure on the occupation authorities to expedite the payment of these reparations.

8.    Stresses its strong condemnation of the barbaric Israeli attack on the humanitarian assistance ship, the Marmara, which constituted a blatant violation of the international law, and welcomes the UN General Assembly Resolution A/RES/65/195 endorsing the conclusions of the International Fact Finding Mission of the UN Human Rights Council, and while reiterating its solidarity with the families of the victims of this attack, supports the demand of the Republic of Turkey to receive an apology for it, and demands the payment of adequate compensations to the victims’’ families.

9    Reaffirms that the City of Al Quds Al Sharif is an integral part of the Palestinian territories occupied in 1967, as stated in the Security Council Resolutions 242 of 1967 and 338 of 1973 to which the Fourth Geneva Convention of 1949, is applicable and in several Security Council Resolutions. Strongly denounces the occupation authorities for their repeated violations of sacred places in the city of Al-Quds Al Sharif through erecting the racist separation wall settlements and continuing excavation works underneath the blessed Al Aqsa Mosque which will result in the collapse of its supporting pillars.  Also denounces Israel’s illegal measures and practices which run counter to international resolutions and laws carried out by the occupation authorities in the city of Al Quds, aimed at the judaization of the Holy City and obliterating its Arab and Islamic landmarks.

10.    Requests the UN Security Council in its capacity as the body responsible for the preservation of international peace and security, to shoulder its responsibilities by taking measures to stop the excavations carried out by the Israeli occupation authorities, immediately remove the racist separation wall and put an end to Israel’s disrespect for international law, and the International Humanitarian Law as well as Security Council resolutions relating to Al Quds; also requests UNESCO to shoulder its responsibility for protecting the buildings of Al-Aqsa Mosque and saving them from Israeli demolishing works.

11.    Requests the Security Council and the Human Rights Council to make Israel committed to applying the Fourth Geneva Convention to the occupied territories and to treat the Palestinian prisoners and detainees in its prisons according to International Law.

12.    Demands the immediate release of the members of the Palestinian Legislative Council who are still behind bars in Israeli prisons.  It also requests the IPU to exercise pressure on Israel in order to realize this purpose.

13.    Calls on the Quartet and the international community to fully shoulder their responsibilities and exert all efforts in order to stop settlement, considered as constituting a blatant violations of the international legitimacy, and revitalize the peace process and resume bilateral negotiations between the two sides aimed at putting an end to the Israeli occupation of all the Palestinian and Arab lands occupied in 1967, including city of Al Quds Al Sharif without delay or procrastination and the establishment of the Independent Palestinian State and consequently arriving at the two States solution according to the resolutions of the international legitimacy   and the Arab Peace Plan.

14.    Expresses its strong concern and anxiety about continuation of division among the ranks of the Palestinian faction and request them to renounce their differences, put an end to the state of schism and to finalize the national dialogue to ensure realization of the Palestinian national unity, and to energize the understandings reached between them in order to serve the higher interests of the Palestinian people and strengthening its ability to continue their just resistance for the sake of recovering their basic national interest.

15.    Welcomes the efforts of the Arab Republic of Egypt and all other efforts exerted to achieve national reconciliation between the Palestinian factions in order to take steps forward with a view to facilitating a just solution of the Palestinian issue.

16.    Stresses its support to all political and media actions, convening conferences and symposia as well as contacts between Member States, on the one hand, and with the other States in order to support the Palestinian issue. This will provide political and media coverage as well as rally world and Islamic public opinion to support the unarmed Palestinian people in the face of Israeli practices.

17.    Requests international institutions to abide by what has been agreed in Sharma Al-Sheikh Conference concerning the rebuilding of Gaza and appeals to Member Parliaments to urge their governments and the Islamic Development Bank to contribute to the reconstruction of the Gaza Strip and building the infrastructure which has been destroyed by the Israeli war machine.

18.    Appeals to the States of the PUIC Member Parliaments to extend generous humanitarian assistance to the Palestinian people to enable them to face the harsh conditions imposed on them by the Israeli occupation.

ON
THE ROLE OF MUSLIM PARLIAMENTS IN CONFRONTING ISRAELI PLANS CONCERNING JEWISHNESS OF ISRAEL AND JUDAIZATION OF AL-QUDS


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Pursuant to the Islamic resolutions which emphasize that the cause of Al-Quds Al-Sharif constitutes the essence of the cause of Palestine which is the core of the Arab–Israeli conflict, and that comprehensive and just peace will only be realized by the restoration of the City of Al-Quds Al-Sharif to the Palestinian sovereignty, considered as the capital of the State of Palestine.   

Emphasizing Security Council Resolution No. 681 of 1990 on application of all the provisions of the Geneva Convention of 1949, and the illegality of any measures and arrangements made by the Israeli side on Palestinian territories and General Assembly Resolution No.58/292, dated 6th May, 2004 concerning the status of the occupied Palestinian territories including city of Al-Quds Al Sharif;

    Referring to resolution No. 129/4 adopted by the General Conference of UNESCO, in its 19th Session, dated November 1967, which affirmed that all legislative measures and arrangements taken by Israel which resulted in altering the status of Al-Quds, including confiscation of lands and real States, are null.

    Taking into consideration the statement issued by the European Union, at the end of its meeting, held on 8/12/2009, at the level of Foreign Ministers, which stipulates that the settlements and the separation wall, built on the occupied land as well as demolition and vacating houses, are illegal steps according to international law, and that they constitute an obstacle to peace and render the two-states solution impossible;

Recalling Arab League Council Resolution No.132, dated 7-9/9/2009, which stipulates rejection of all illegal Israeli measures aimed at annexing and Judaizing the city, as well as condemnation of all the official and non-official Israeli political programs and policies concerning its declaration as the capital of Israel; and inviting the international community to apply the resolutions of the international legitimacy in this regard;

Referring anew to the draft resolution of the Joint Committee Meeting (106th) of the IPU, on 14/9/2001, which called on Israel to defuse tension, withdraw immediately its military forces from Palestinian towns and villages, freeze all settlement activities, desist from attacking civilians and installations, and lift its siege of Palestinian territories.

Recalling once again the resolutions adopted by the Third ICFM, especially Resolution No. 4/3 on Judaization of Al-Quds, which requests the Member States to exercise global pressure on Israel through the big powers, and appeal to international organizations to force Israel to implement the UN and Security Council resolutions;

Commending the condemnation of the international and regional communities of all settlement operations carried out by Israel, and their defense of the Palestinian cause, and adoption in all fora of resolutions aimed at establishing an independent Palestinian State with Al-Quds Al Sharif as its capital;

1.    Mandates the PUIC Secretary General with following up his study of forming a Standing Committee on Palestinian Affairs, specify its terms of reference and members, in preparation for its adoption by the next conference scheduled to be held in the Republic of Indonesia.
2.    Requests the PUIC Secretary General to address the UN Secretary General and the IPU Secretary General, and ask them to exert efforts for stopping Israeli measures aimed at judaizing Al-Quds City.
3.    Upholds the position of rejecting all attempts to break up the integrity of Palestinian lands, and all unilateral measures taken by Israel, foremost of which are settlement activities in the occupied Arab territories and attempts to judaize Al-Quds.
4.    Invites the Vatican, all the Christian churches to participate in resisting the judaization of the City of Al-Quds Al-Sharif, being keen on respecting the spiritual dimension of all divine religions and ensuring peaceful coexistence between their peoples.
5.    Condemns Israeli measures that prevent inhabitants of the Western Bank from entering Al-Quds, and its persistent attempt to include Al-Quds in its preparatory list of antiquities in order to record it as an Israeli site on the list of world heritage, in a blatant defiance of international law, and the resolutions of the international legitimacy contrary to international charters and conventions, including the World Heritage Convention.
6.    Calls for energizing cooperation among Islamic States in a way that serves the cause of Palestine and preserves the Arab and Islamic identity of Al-Quds city and safeguards its religious sacred sites and historical antiquities, and calls on the States which have declared the twining of their capitals and cities with the city of Al Quds Al Sharif to adopt projects which strengthen the steadfastness of the holy city, its people and institutions.

ON
SYRIAN ARAB GOLAN


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Recalling Israeli violation of Article 25 of the UN Charter and its non-compliance with the resolutions of the UN Security Council, specially resolution No.497 of 1981 which considers Israeli annexation of the occupied Syrian Golan as null and void and without legal effect, and that it is a defiance of the will of the international community,

Being aware of the suffering of the Syrian citizens in the occupied Golan from Israeli repressive measures and continuous attempts to force them to accept the Israeli identity,
   
Affirming the applicability of the Geneva convention concerning the protection of civilian inhabitants during the time of war of 1949 to the Occupied Syrian Golan, and that the establishment of settlements and the introduction of settlers to the Occupied Syrian Golan constitutes a violation of this conventions and a destruction of the peace process,

Expressing its concern about Israel’s destruction of the peace process through its intransigence and its non-application of international resolutions, specially UN Security Council resolutions 242 and 338,

Commending the steadfastness of the Syrian Arab people in the face of Israeli arrogance and Israel’s continued occupation of the Golan
   
1.    Reaffirms all the resolutions adopted by relevant Islamic Conferences on all the occupied Arab territories, particularly the Syrian Arab Golan.
2.    Praises the steadfastness of the Syrian citizens in the occupied Syrian Golan, and hails their attachment to their land and Syrian Arab identity.
3.    Expresses its support to the established positions of Syria and its commitment to achieving a just and comprehensive peace in the region.
4.    Strongly condemns the decisions of Israel to impose its laws and administration on the occupied Syrian Golan and its non-abidance by Security Council resolution No. 497 of 1981; affirms that all these Israeli decisions are null and illegal.
5.    Supports the right of Syria to recover the Syrian Arab Golan according to the resolutions of international legitimacy.
6.    Urges the Member Parliaments to request their respective governments to exercise pressure on the UN in order to compel Israel to withdraw from the Syrian Arab Golan.

ON
THE SITUATION IN LEBANON


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Lauding Lebanon’s steadfastness and its heroic resistance to the savage Israeli aggression in the summer of 2006,

Taking note of the Israeli continuing occupation of the Lebanese Shaba Farms and Kafar Chouba Hills and its continuous aggression on Lebanon’s sovereignty,

Stressing the stand by the side of Lebanon concerning human victims as well as the material and economic losses which it incurred and the pillaging of its water resources as a result of the Israeli aggression on its citizens and the infrastructure and the concomitant massive injuries and losses in lives and properties.

1.    Reaffirms all resolutions adopted by Islamic Conferences relating to the situation in Lebanon.

2.    Stresses solidarity with Lebanon and ensuring political and economic support to the Lebanese people in such a way as to preserve Lebanese national unity, and Lebanon’s security, stability and sovereignty over its entire territories.  Also supports the position of the State of Lebanon on inviting the international community to apply resolution No.1701, in such a way as to realize the Lebanese interest and to put an end to Israel’s violation of the Lebanese sovereignty, its persistent threat and espionage operations which it carries out against Lebanon

3.    Commends also Arab and Islamic efforts exerted to achieve national reconciliation between groups in Lebanon, and calls on the Lebanese leaders to opt for wisdom, dialogue and expeditiously act to constitute a government of national unity based on Arab initiatives, primarily the Syrian-Saudi initiative, and act to completely implement Taif agreement.

4.    Condemns the Israeli threat to resort to force against Lebanon, its military maneuvers on the borders of Lebanon, the deployment of combat formations as well as air and sea violations, and continuation to occupy the Lebanese Sheba Farm, Kafar Shuba Hills and the Lebanese section of gajar village, which conflict with UN Security Council resolution 1701.

5.    Commends the positive developments of brotherly relations between the Republic of Lebanon and the Syrian Arab Republic.

6.    Emphasizes the right of the Lebanese people and their heroic resistance to recover Lebanon’s sovereignty over all their occupied territories, including Lebanese Sheba Farms, Kafar Sheba Hills and the Lebanese part of gajar village up to the area beyond the Blue Line in accordance with the relevant international resolutions.

7.    Urges the Member Parliaments to request their respective governments to exercise pressure on the United Nations in order to force Israel to withdraw from all the occupied Lebanese territories,

8.    Affirms the necessity of pressuring Israel to release all Arab detainees from its prisons and to recover the bodies of martyrs.

ON
SUPPORTING THE EQUAL AND INALIENABLE RIGHTS
OF ALL NATIONS TO HAVE FREE ACCESS TO AND USAGE OF MODERN TECHNOLOGY AND ENERGY FOR THEIR PEACEFUL PURPOSES


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Aware of the undeniable role and the contribution of knowledge and modern technologies to enabling all nations to achieve prosperity and development,

Taking into consideration the provisions of the UN Charter, including respect for equal rights among nations in raising the standards of living as well as the conditions of their economic development without discrimination,

Recalling the Ten Year Programs of Action of the OIC which encourages public and private research institutions to invest in the technology of capacity building in the fields of advanced technologies such as possessing nuclear technology for peaceful purposes,

Recognizing the limited sources of energy and the need to use modern technology for searching for new ways and means, including the use of nuclear energy in order to address possible future shortage in energy,

Taking into consideration that International Law recognizes the right of all nations, especially developing countries, to have free access to and use of technologies in all fields for peaceful purposes,  

Reconfirming the inalienable rights of all states, without discrimination, to develop new technologies, especially nuclear energy for peaceful purposes in accordance with their legal commitments,

Expressing concern about attempts to restrict the use of modern technologies, including the peaceful use of nuclear energy, also strongly concerned about the restrictions imposed by some States on international cooperation in the field of research and transfer of equipment, material and technology for the peaceful purposes of nuclear energy in contradiction with Article 4 of the NPT;

Reconfirming that there is nothing in the NPT as well as the statute of the IAEA which may be construed as affecting the inalienable right of all parties to develop and use atomic energy for peaceful purposes,

Reconfirming the inalienable right of countries to the use of nuclear energy for peaceful purposes as well as confirming the necessity of respecting the options and resolutions of each country in the field of peaceful use of nuclear energy, including their policies relating to nuclear fuel cycle;

1.    Confirms once again the equal and the inalienable right of all nations to have free access to modern technologies and use them for peaceful purposes.

2.    Recognizes the important role of modern technologies, especially in the field of nuclear energy, in the economic development of nations.

3.    Stresses the need for ensuring total respect for the equal and inalienable rights for all nations to explore and benefit from modern technologies, including, inter alia, nuclear energy for peaceful purposes.

4.    Urges all parliaments to maintain further cooperation in order to establish a world free of discrimination, injustice and double standards.

5.    Recognizes that any attempt aimed at limiting the application of peaceful nuclear energy, which is in conflict with the international law, will affect sustainable development of developing States.

6.    Expresses concern about the creation of obstacles by certain circles before free access to modern technology by developing countries, and calls upon these States to remove all these obstacles.

7.    Rejects discrimination and double standards concerning the peaceful uses of modern technology, including nuclear energy.

ON
MAKING THE MIDDLE EAST A ZONE FREE OF WEAPONS OF MASS DESTRUCTION


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

    Recalling the resolution of the  Islamic Summit, held in Tehran, in December 1997, concerning creation of a zone free of weapons of mass destruction, including nuclear weapons in Africa, the Middle East and South-East Asia, and the call for ridding the world of all weapons of mass destruction;

    Stressing the resolution of the Islamic Summit Conference No. 22-8/P(IS) on committing Israel to abide by the UN resolutions, especially Security Council resolution 487 of 1981, and its accession to the NPT;

    Insisting on the resolution of IAEA, adopted in August 2005, which recognizes the right of States to develop and use atomic energy for peaceful purposes, including the generation of electricity, in conformity with the commitments enshrined in the NPT;

    Welcoming the IAEA Resolution No. GC(53) RES/17, of September 2009, which expresses concern about the nuclear capabilities of Israel, while advocates a Middle East free of weapons of mass destruction, and urges Israel to open its nuclear facilities for international inspection;

1.    Affirms the resolution of the 31st ICFM adopted in Istanbul on 16th June 2004, which requests the international community and the Security Council to commit Israel to abide by the resolutions of the United Nations, specially Security Council resolution No. 487 for the year 1981, and to join the NPT, and implement the resolutions of the General Assembly and the International Atomic Energy Agency which call for subjecting all Israeli Nuclear facilities to the Comprehensive IAEA Safeguards System, and stress the necessity of Israel’s declaration to renounce nuclear armament as well as submit a statement on its capabilities and stock pile of nuclear weapons and material to both the Security Council and the IAEA, considering that such steps are necessary for making the area a zone free of weapons of mass destruction, foremost of which are the nuclear weapons. This is an essential matter for the establishment of the comprehensive and just peace in the area. The treatment of Israel as an exception on which the international resolutions do not apply must be stopped; also applying pressure on others at the same time is unacceptable.

2.    Affirms the inalienable right of all States of Member Parliaments to develop nuclear energy and technology for peaceful purposes, and encourages cooperation among them in this field according to the provisions of the Nuclear Non-Proliferation Treaty and the IAEA Safeguards System;

3.    Calls for facilitating and promoting cooperation in the field of developing nuclear energy and its use for peaceful purposes, whether in the region, between its States or outside States, without any discrimination, while taking into consideration the commitments of States to the NPT;

4.    Confirms the necessity of Israel’s compliance with the resolutions of the UN Security Council and the IAEA on elimination of weapons of mass destruction, especially nuclear weapons, as this is considered essential to security and stability in the Middle East, and demands Israel’s accession to the NPT, and subjection of its nuclear facilities and programs to IAEA inspection.

THE SITUATION IN IRAQ


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Expressing its satisfaction with the success of the political process in Iraq through conducting parliamentary elections on 7th March, 2010, which resulted in the formation of a National Unity Government that included all the categories of the Iraqi society and hoping that this government will fulfill the aspirations of the Iraqi people and realize their wishes in ending occupation and consolidating independence and national sovereignty as well as the establishing peace in all Iraq;

Pursuant to the recognition of Members of the importance and necessity of achieving security and stability for the Iraqi people and being keen on respecting the sovereignty, territorial integrity of Iraq and the unity of its people as well as non-intervention in its domestic affairs, and the importance of international support in realizing Iraq’s security and stability and the rejection of any calls for its partition;

Denouncing terrorist acts which target innocent people and endanger their lives and properties as well as disperse them from their houses and homes,

1.    Calls on the State of the PUIC Member Parliaments to support the efforts of the Iraqi government to restore security and stability to different parts of Iraq, achieve national reconciliation among the Iraqi people, support its national economy, restore its total sovereignty, assist in the reconstruction efforts, return the refugees to their regions and exert efforts to help them recover their desired position and expected role in Arab, Islamic and international milieu;

2.    Welcomes the decisions by a number of State of the PUIC Member Parliaments on resumption of the functioning of their diplomatic missions in Iraq and calls on all States to open or reopen their embassies or diplomatic missions in Iraq.

3.    Renews its support to rebuilding Iraq and rejuvenating its economy by extending assistance, and dealing with debts and encouraging owners of capital to invest their funds in Iraq,

4.    Calls on the international community and human rights organizations to prevent violations of human rights and seek reformation of prisons as well as punishing those responsible for crimes of torture, also calls on Iraq to finalize implementation of remaining international resolution relevant to the liberation of Kuwait. 

5.    Appeals to the State of the Member Parliaments to ban extremist religious and media rhetoric which advocates for violence and terrorism in Iraq under any slogan or in any way, especially TV channels owned by these States or operating on their territories.

6.     Reaffirms the unity and security of the territory and people of Iraq, the respect of its sovereignty and its Arab-Muslim identity and rejects any call for secession, while insisting on the need of non-interference in its internal affairs.

7.    Supports national reconciliation between the different categories and components of the Iraqi people, on the basis of equality in rights and obligations and the widening of political operations to better counter and eliminate sectarianism, while putting special emphasis on equality and the rejection of any attempt at consecrating sectarianism and division.

8.     Denounces all terrorist acts in Iraq, welcomes the establishment of peace and supports the safety and stability now prevailing in Iraq.

9.     Emphasizes the importance of building and reinforcing all constitutional institutions so that they can play an effective role in dismantling the different militia and discarding all armed manifestations, while expediting the building of capacities and training the armed and security forces, on a national basis, in such a way as to preserve the security, stability, sovereignty, and national unity of Iraq

THE SITUATION IN THE SUDAN


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Confirming all its previous resolutions which are supportive of the efforts exerted by the Sudanese government to establish peace, security and stability in all parts of the country;

Referring to its resolutions concerning the allegations made by the International Criminal Court against the Sudan;

Following with the utmost attention the critical phase through which the Sudan is passing:

1.    Expresses its understanding of the options of the Sudanese people vis-à-vis the results of the referendum, considered as one of the entitlements of the Comprehensive Peace Agreement and highly appreciates the efforts exerted to implement the remaining items of the agreement

2.    Stresses its firm stand on the side of the Sudan against external threats, and expresses solidarity with it in defending its sovereignty, stability, unity and development.

3.    Affirms its rejection of the decision of the International Criminal Court and the allegations of its Prosecutor General against the Sudanese Leaders which constitute a flagrant violation of the international law, as well as a blatant violation of the national sovereignty of the Republic of the Sudan

4.    Highly appreciates the efforts of the State of Qatar and the Joint Mediation of the United Nations, the African Union, the League of Arab States, and the OIC, aimed at establishing peace in Darfur, and calls on the international community to fulfill all its declared obligations towards realizing just and comprehensive peace in the three Darfur states

COMBATING INTERNATIONAL TERRORISM


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Affirming that paragraph four of Article 2 of the UN Charter stipulates that all Members of the organization shall refrain in their international relations from threatening or using force against the safety of the lands or political independence of any State or in any way which does not conform with the aims of the United Nations, and that commitment to the provision of this paragraph is an essential necessity and binding on all Members of the United Nations,

Recognizing that Article 51 of the UN Charter permitted for the Member States to use force in self-defense by stating that there is nothing in the Charter that weakens or diminishes natural rights of States, individually or collectively, to defend themselves in case of armed aggression against any UN Member,

Registering Israel’s practices in occupied Palestine as state terrorism against the unarmed Palestinian people, and murdering innocent children, women, the elderly and youth, establishing settlement rings, destroying cities and villages, and bulldozing plantations and trees under the slogan (security above all consideration), in addition to the continued illegal occupation of the Syrian Golan, Lebanese Sheba Farms and the Kafr Chouba Hills,   

Confirming that actions carried out by the USA and Israel do not conform with alleged threats to them.  Both of them work to confuse concepts that control the limits of relations between resisting occupation and terrorism by using violence against innocent civilians for the sake of self-interest that serve their drive for settlement and hegemony over the potential of Islamic States which clearly contradicts and openly defies international laws and conventions, specially the UN Charter;

1.    Confirms that resisting occupation in Palestine, Iraq, Afghanistan, Kashmir and in all parts of the world is not considered terrorism but rather a legitimate right of occupied nations to restore their rights and sovereignty

2.    Stresses that the phenomenon of launching aggression against civilians contradicts all teachings of Islam which call for tolerance, mercy and non-violence, and ban all forms of aggressions, especially killing of humans irrespective of color, religion or race, rejects all politically motivated attempts to unjustly establish a link between Islam or any Muslim country, and terrorism.  

3.    Stresses that Islam is a religion that calls for peace and security and combats violence, injustice and despotism, carrying out terrorist actions by a wrong doing group alleging commitment to Islam does not alter the sublime concept of Islam.

4.    Hails the positions of non-Muslim followers of divine religions who reject the Zionist American of definition of resisting occupation as terrorism, noting that terrorism knows no homeland or religion. And deems that such positions contribute to joint earnest action to counteract all dangers that threaten humanity, including terrorism itself.  

5.    Denounces the pressures put on Islamic States aimed at accusing them of supporting terrorism in order to prevent them from backing Palestinian and Lebanese resistance.

6.    Invites the international community to confront State terrorism which is practiced by Israel and demands to stop treating it as an exception to which international laws are not applicable, as well as compelling it to abide by the international law and the UN Charter. 

7.    Requests the implementation of a global strategy in the field of combating terrorism under UN umbrella and adopting necessary measures and arrangements to preserve international peace and security.  Affirms the role of the UN as an effective force in combating terrorism and calls for concluding a comprehensive international agreement to combat terrorism under UN Umbrella, which must, in the first place, prepare a definition of terrorism.

8.    Reaffirms the right of all state of Member Parliaments to protect their national territory and borders by taking all the necessary measures to protect their national security.

9.    Stresses the right of peoples under occupation to obtain their independence and confirms their right to resist occupation with all forms of resistance that their struggle for liberty and sovereignty shall not be used to accuse them of endangering international security and peace.

10.    Denounces using, or threatening to use, military force against any Member State on the pretext of combating terrorism.

11.    Calls for energizing the international law and reconsidering the work mechanism of the UN so that it shall not remain as a tool in the hands of some big powers, which they employ for their special aims and purposes. It is necessary for the UN to overcome in its work (the place complex), meaning the place of its headquarters, so that it is able to realize the hopes of helpless States.
 
12.    Welcomes the announcement of the Syrian People’ Assembly to host an International Conference on Terrorism, in implementation of a resolution adopted by the Kampala Conference and stresses the importance and necessity of holding this conference in an appropriate time agreed upon by in coordination with the host country and mandates the General Secretarial with preparing a complete study in this respect for submission to the conference.

PROMOTING SOLIDARITY AND UNITY AMONG MUSLIM STATES TO CONFRONT INCREASING CHALLENGES WHICH TARGET THE CAPABILITIES OF THE ISLAMIC UMMAH


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Guided by the Holy Quran which says “And verily this Ummah of yours is a single Ummah and I am your Lord, therefore worship me” and also “And verily this Ummah of yours is a single Ummah and I am your Lord and Cherisher: therefore fear Me (and no others)”,

Also guided by the Holy Quran, which enjoins on Muslims, to achieve unity as stated in the text of the verse: “And hold fast, all together, by the rope which Allah (stretches out for you) and be not divided among yourselves…”,

Reconfirming the provisions of the PUIC Statute, which stress the necessity for Muslims to close their ranks and consolidate their unity, as well as the role of parliamentary assemblies in supporting this trend.

Taking into consideration all the relevant statements and resolutions adopted by the Union,

Deeply concerned about the continuous lapses in Islamic solidarity among Islamic countries due to the enemies of Islam and Muslims sowing the seeds of discord among Muslims through various strategies, policies and plans,

Aware of the great harm, resulting from disputes among the followers of the different Islamic schools of thought, including sectarian violence, and their impact on the solidarity and unity of the entire Muslim Ummah;

Aware of the importance of understanding and cooperation between brothers from different Islamic sects and its positive impact on the strengthening of Islamic solidarity;

Reiterating the importance of further efforts for the rapprochement of the Islamic schools of thought, as a first step to unite the sons and daughters of the Islamic Ummah in their endeavors to meet the huge challenges facing them;

1.    Affirms the need to eliminate all causes for prejudice, hatred, provocation and incitement as well as sectarian violence among the followers of various Islamic schools of thought,

2.    Recognizes the great importance for Member Parliaments to  strengthen Islamic brotherhood and unity considered as a sacred religious obligation aimed at achieving the common interests of the Islamic Ummah,

3.    Affirms that both the causes of Palestine and AL-Quds Al Sharif must remain the primary issues on which Member States should adopt a unified Islamic position in international fora.

4.    Stresses the important role of Member Parliaments in strengthening mutual understanding, tolerance and respect among followers of Islamic schools of thought in such a way as to contribute to the consolidation of bonds of brotherhood among Muslims, as they share the same beliefs and the same commitment to carry out the obligations of Islam,

5.    Stresses also the necessity for all Muslims to maintain vigilance and attention and awareness to understand that any conflict among the followers of Islamic schools of thought will harm all the peoples of the Islamic Ummah and endanger its solidarity, brotherhood and unity.

6.    Invites all Muslims to desist from inciting sectarian sentiments or ethnic strife or insult or bias or abuse. Also calls for being on guard towards all attempts to sow the seeds of discord between them.

7.    Denounces sectarian violence among followers of Islamic schools of thought in any part of the Islamic world and strongly condemns all crimes which are committed on the basis of sectarian identity or affiliation.

8.    Reaffirms the importance of never relinquishing principles, including unity, understanding, solidarity and cooperation to achieve probity and piety and emphasizes that the blood, properties, honor, reputation of  Muslims must be preserved and that all Muslim places of worship must be respected;

9.    Urges all Muslim scholars, religious institutions and mass media in the Islamic world, owing to their importance, to reinforce the spirit of tolerance, understanding, and mutual respect among the followers of different Islamic schools of thought;

10.    Invites all Member Parliaments to take into consideration the great importance of this issue and take appropriate measures to strengthen and promote Islamic unity.

THE SITUATION IN SOMALIA


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Recalling all resolutions adopted by the Islamic Summit Conferences and ICFM Conferences concerning the situation in Somalia and the set of challenges relating to prevailing political, humanitarian, social and economic conditions,

Also recalling the efforts of the OIC and its cooperation with international organizations such as the UN, League of Arab States and African Union.  Also recalling the OIC  initiative of 1992 concerning extension of international relief to Somalia and commending all humanitarian assistance and relief efforts extended by the international community,

Stressing the recommendations made by the OIC Contact Group on Somalia,

1.    Stresses its commitment to restore and preserve the unity, sovereignty, territorial integrity and political independence of Somalia and restoration of security therein.

2.    Confirms the necessity of foreign non-intervention in Somalia by any party, and preserving its independence, territorial integrity

3.    Calls for achieving national reconciliation between all parties in order to serve the higher interests of the Somali people; exerting efforts and making necessary contact in order to achieve that goal through endorsement of dialogue as the best possible means to solve its problems.

4.    Also calls for immediate cessation of acts of piracy which is endangering security, peace and freedom of international shipping, and appeals to Islamic States and all the international community to provide assistance to Somalia in order to confront piracy attributed to it.

5.    Invites the OIC Member States to extend assistance to the Somali people to help them meet the challenges and problems facing people of Somalia specially the conditions of drought and repercussions of war and calls for further efforts in cooperation with the international humanitarian organizations to realize comprehensive development and rebuild the infrastructure of the Republic of Somalia.

6.    Appeals to Islamic parliaments to support Somalia’s Parliament materially and morally in order to strengthen its message and role in promoting parliamentary culture among the Somali people instead of the culture of war and conflicts.

THE SITUATION IN CYPRUS

The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Recalling the resolutions No.2/31-P and 6/34-P on the situation in Cyprus adopted at the 31st and 34th Sessions of the Islamic Conference of Foreign Ministers, held in Istanbul and Islamabad, on 14-16 June 2004 and 15-17 May 2007 respectively, which enabled the Turkish Muslim people of Cyprus to participate in the OIC under the name of Turkish Cypriot State as envisaged by the UN Secretary General’s comprehensive settlement plan;

Recalling Resolution  No. 4 on the situation in Cyprus adopted at the 4th Session of the PUIC Conference held in Istanbul, on 12 - 13 April 2006, which enabled the Turkish Muslim people of Cyprus to participate as Observer in the PUIC under the name of Parliament of Turkish Cypriot State in accordance with the relevant OIC resolutions;

Also recalling the resolutions on the situation in Cyprus adopted by the 32nd, 33rd  and 34th Sessions of the Islamic Conference of  Foreign Ministers held in Sana’a (5/32-P), Baku (5/33-P) and Islamabad (6/34-P) on 28-30 June 2005, 19-21 June 2006 and 15-17 May 2007 respectively, which called upon the Member States to take concrete steps to end the economic, political and cultural isolation of the Turkish Cypriots and reaffirmed the full equality of the two parties in Cyprus;

Also recalling Resolution No. 10 adopted at the PUIC Council meeting in its Ninth Session held in Kuala Lumpur on 15-16 February 2007, which supports the efforts of the UN Secretary General in the framework of his good-offices mission to achieve a comprehensive settlement in Cyprus based on UN established parameters established by the UN;

Bearing in mind that the Turkish Cypriot State accepted UN Secretary General Boutros Ghali’s set of ideas, Document de Cuellar and Annan Plan and the Greek Side refused all these;

Referring to the Agreement signed between Israel and the Greek Cypriot Administration concerning the issues being negotiated between the two Cypriot leaders under the auspicious of the United Nations, considering that this agreement prejudices the ongoing negotiations as well as the Geneva Meeting organized by the United Nations under the sponsorship of its Secretary General Ban Ki-Moon on 25 – 26 January, 2011,

1.    Calls upon the state of the PUIC Member Parliaments to support effective solidarity with the Turkish Cypriot State and maintain close links with it, aiming to help it overcome the inhuman isolation imposed on it, and consolidate and strengthen their relations with the Turkish Cypriot State in all fields.

2.    Calls for extending effective assistance to include the legitimate demands of the Turkish Cypriot State concerning the right of Turkish Cypriots to have their voice heard in all international fora on the basis of equality between the two parties in Cyprus until a just, lasting and comprehensive settlement to the Cyprus question is achieved.

3.    Reiterates the necessity and urgency of finding a just, viable and comprehensive solution to the Cyprus question that has been on the agenda of the UN Security Council for close to 47 years which will be based on the UN parameters of bi-zonality, bi-communality, political equality and equal status of the two constituent States and a new partnership State structure and support the good-offices mission of the UN Secretary General.

4.    Condemns the agreement on drawing up economic zones signed between the Greek Cypriot administration and Israel because it disregards the rights of the Turkish Cypriots, and considers that this agreement endangers the negotiations between the Turkish and Greek Cypriots

5.    Welcomes the willingness shown by the Turkish Cypriot State and Turkey for finding a political and viable agreement, and shares the UN Secretary General’s view that the negotiation process cannot be open-ended and the opportunity must be utilized before it is too late.

6.    Expresses its recognition that in case of the failure of the process once more, the Muslim Turkish Cypriot people will not be left isolated, and welcomes the call of the UN Secretary General to international community to preserve economic, social and cultural relations with the Turkish Cypriot people, and stresses that there is no contradiction between ending the isolation imposed on the Turkish Cypriot and the resolutions of the UN Security Council.

THE SITUATION IN JAMMU AND KASHMIR


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Reaffirming the principles and objectives of the PUIC Statute and the Charter of the Organization of the Islamic Conference and the United  Nations relating to the importance of achieving people's rights  of self-determination and recalling the resolutions of the United Nations relating to the conflict in Jammu and Kashmir that have not been implemented yet,

Referring to the Simla Agreement concluded between the governments of Pakistan and India stipulating to find a final settlement to Jammu and Kashmir issue,

Emphasizing the declarations relating to Jammu and Kashmir issued by the 7thand 10thConference of the Islamic Summit and the two Extraordinary Sessions of the Islamic Summit Conferences held in Casablanca in 1994 and in Islamabad in 1997 and all the previous resolutions issued by the PUIC and the OIC on the conflict of Jammu and Kashmir, specially the resolution No. 34/2-P  as well as the reports of the ministerial meeting and that of the OIC Contact Group on Jammu and Kashmir and supporting the recommendations set in it,

Taking Note of the uprising of the people of Kashmir in July 2008 which was ignited by the Amaranth Temple land issue, and expressing its concern about the use of indiscriminate force against the Kashmiri people who were protesting over the harsh living conditions imposed on them by the Indian authorities which often result in the death of innocent Kashmiri people,

Expressing its concern about the violation of human rights for Kashmir's people and stigmatizing their struggle with terrorism, as well; expressing its regret for the prevention by India of the OIC Fact Finding Mission to visit to Jammu and Kashmir occupied by India and its non-response to the proposal made by the OIC through delegating a good offices mission,

1.     Calls for finding a peaceful resolution for the Jammu and Kashmir issue in accordance with the relevant resolutions of the United Nations and Agreed provisions of the Simla Agreement.

2.     Supports the current efforts deployed by the government of Pakistan in order to find a peaceful solution for the Jammu and Kashmir conflict by using all ways and means, including substantive bilateral talks with India according to the will of Jammu and Kashmiri people and their legitimate right in self-determination.

3.     Appeals to the States of the PUIC Member Parliaments to mobilize resources and generously contribute to providing humanitarian assistance to the people of Jammu and Kashmir.

4.    Calls on India to stop immediately its blatant and systematic violations of the human rights of the people of Kashmir and allow international human rights groups and humanitarian organizations to visit Jammu and Kashmir

THE AGGRESSION OF THE REPUBLIC OF ARMENIA
AGAINST THE REPUBLIC OF AZERBAIJAN


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Proceeding from the principles and objectives of the PUIC Statute and the Charter of the Organization of the Islamic Conference;

Gravely concerned over the aggression by the Republic of Armenia against the Republic of Azerbaijan which has resulted in the occupation of about 20 percent of the territories of Azerbaijan;

Expressing its profound concern over continued occupation of significant part of the territories of Azerbaijan and illegal transfer of settlers of the Armenian nationality to those territories;

Deeply distressed over the plight of more than one million Azerbaijani displaced persons and refugees resulting from the Armenian aggression and over the magnitude and severity of these humanitarian problems;

Reaffirming all previous relevant resolutions and, in particular, Resolution No.10/11-P(IS), adopted by the Eleventh Session of the Islamic Summit Conference held in Dakar, Republic of Senegal, from 6-7 Rabi ul Awwal, 1429H ( 13-14 March 2008) and Resolution No.11/5-CONF, adopted by the Fifth Session of the Conference of the Parliamentary Union of the OIC Member States (PUIC), held in Cairo, Arab Republic of Egypt, on 22-23 Muharram 1429H, (30-31 January 2008);

Urging strict adherence to the Charter of the UN and full implementation of the relevant Security Council resolutions;

Welcoming all diplomatic and other efforts for the settlement of the conflict between Armenia and Azerbaijan;

Reaffirming commitment by all the State of PUIC Member Parliaments to respect the sovereignty, territorial integrity and political independence of the Republic of Azerbaijan;

Noting also the destructive influence of the policy of aggression of the Republic of Armenia on the peace process within the OSCE framework;

1.    Strongly condemns the aggression of the Republic of Armenia against the Republic of Azerbaijan.

2.    Considers the attacks on civilian Azerbaijani population in the occupied Azerbaijani territories crimes against humanity.

3.    Strongly condemns any looting and destruction of archeological, cultural and religious monuments in the occupied territories of Azerbaijan.

4.    Strongly demands the strict implementation of the United Nations Security Council resolutions 822, 853, 874 and 884 as well as the United Nations General Assembly resolution A/RES/62/243, and the immediate, unconditional and complete withdrawal of Armenian forces from all occupied Azerbaijani territories including the Nagorno-Karabakh region and strongly urges Armenia to respect the sovereignty and territorial integrity of the Republic of Azerbaijan.

5.    Expresses its concern that Armenia has not yet implemented demands contained in the above stated UN Security Council resolutions.

6.    Calls on the UN Security Council to recognize the existence of aggression against the Republic of Azerbaijan; to take the necessary steps under Chapter VII of the Charter of the United Nations to ensure compliance with its resolutions; to condemn and reverse aggression against the sovereignty and territorial integrity of the Republic of Azerbaijan, and decides to take coordinated action to this end at the United Nations.

7.    Urges all States to refrain from providing any supplies of arms and military equipment to Armenia, in order to deprive the aggressor of any opportunity to escalate the conflict and to continue the occupation of the Azerbaijani territories. The territories of the State of the PUIC Member Parliaments should not be used as transit of such supplies.

8.    Calls upon States of PUIC Member Parliaments, as well as other Members of the international community, to use such effective political and economic measures as required in order to put an end to Armenian aggression and occupation of the Azerbaijani territories.

9.    Calls for a just and peaceful settlement of the conflict between Armenia and Azerbaijan on the basis of respect for the principles of territorial integrity of States and inviolability of internationally recognized borders.

10.    Decides to instruct the Permanent Representatives of Member States at the United Nations in New York, while voting at the UN General Assembly, to give full support to the issue of territorial integrity of the Republic of Azerbaijan.

11.    Urges Armenia and all Member States of the OSCE Minsk Group to engage constructively in the ongoing OSCE peace process on the basis of the relevant resolutions of the UN Security Council and the relevant OSCE decisions and documents, including those of the First Additional Meeting of the OSCE Council on 24 March 1992, OSCE Summits of 5-6 December 1994, 2 - 3 December 1996, 18 - 19 November, 1999, and refrain from any action that will make it more difficult to reach a peaceful solution.

12.    Expresses its full support for the three principles of the settlement of the armed conflict between Armenia and Azerbaijan contained in the Statement of the OSCE Chairman-in-Office at the 1996 Lisbon OSCE Summit, namely the territorial integrity of the Republic of Armenia and the Republic of Azerbaijan, highest degree of self-rule of the Nagorno-Karabakh region within Azerbaijan and guaranteed security for this region and its whole population.

13.    Stresses that fait accompli shall not serve as a basis for a settlement, and that neither the current situation within the occupied areas of the Republic of Azerbaijan, nor any actions, including arranging voting process, undertaken there to consolidate the status quo, may be recognized as legally valid.

14.    Demands to cease and reverse immediately the transfer of settlers of Armenian nationality to the occupied territories of Azerbaijan, which constitute a blatant violation of international humanitarian law and has a detrimental impact on the process of peaceful settlement of the conflict, and agrees to render its full support to the efforts of Azerbaijan undertaken to this end, including at the General Assembly of the United Nations, inter-alia, through their respective Permanent Missions to the United Nations in New York.

15.    Requests the State of PUIC Member Parliaments not to encourage their legal and physical persons to engage in economic activities in the Nagorno-Karabakh region and other occupied territories of Azerbaijan.

16.    Expresses its support to the activities of the OSCE Minsk Group and consultations held at the level of the Foreign Ministers of Azerbaijan and Armenia and their understanding that a step-by-step solution will help to ensure gradual elimination of the most serious consequences of the aggression against the Republic of Azerbaijan.

17.    Reaffirms its total solidarity with and support for the efforts undertaken by the Government and people of Azerbaijan to defend their country, and stresses its support for their steadfastness in demanding their legitimate rights.

18.    Calls for enabling displaced persons and refugees to return to their homes in safety, honor and dignity.

19.    Expresses its appreciation of all the States of the Member Parliaments which have provided humanitarian assistance to the refugees and displaced persons and urges all others to extend their contributions to these people.

20.    Expresses its concern over the severity of humanitarian problems concerning the existence of more than half million displaced persons and refugees in the territory of the Republic of Azerbaijan and requests the States of the PUIC Member Parliaments, the Islamic Development Bank and other Islamic institutions to render much needed financial and humanitarian assistance to the Republic of Azerbaijan.

21.    Considers that Azerbaijan has the right for appropriate compensation with regard to damages it suffered as a result of the conflict and puts the responsibility for the adequate compensation of these damages on Armenia.

REJECTING ALL SANCTIONS IMPOSED ON ANY ISLAMIC COUNTRY


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Recalling the principles and purposes of the PUIC Statute and the UN Charter,

Also recalling the objectives and principles stipulated in the PUIC Statute and the OIC Charter, especially those that call for promoting solidarity among Islamic States and strengthening their ability to protect their security, sovereignty, independence and national rights, 

Referring to the UN Resolutions 22/51 and 17/51 on economic sanctions which are unilaterally imposed by UN Member States against other Member States,

After taking note of the statements, declarations, and resolutions adopted by the various governmental and international fora as well as non-governmental organizations, which express rejection by the international community of the superseding of national legislations of one State by the rules of international law aimed at prejudicing the sovereignty and interests of States and their peoples,

1.    Strongly rejects the principle of imposing any kind of sanctions, whether unilateral or multilateral, on any Islamic State and expresses strong solidarity with these States.

2.    Condemns the continuation of sanctions on Islamic States and demands their immediate lifting as well as stresses the respect of the sovereignty of States and non interference in their internal affairs.

3.    Calls for considering the adoption of legal and administrative measures to confront the application of unilateral coercive measures whose effects surpass the local legal and legislative jurisdiction.

THE NECESSITY TO CONDUCT CONSULTATIONS
AND PRIOR COORDINATION BETWEEN ISLAMIC PARLIAMENTS ON THE SIDELINE OF INTERNATIONAL MEETINGS


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Inspired by the noble Islamic principles and teachings which enjoin on Muslim people, inter alia, to consult equality among themselves, to unite their ranks and consolidate their unity,

Reaffirming also the objectives of the Union particularly the provisions of the 3rd paragraph of Article - 1 of its Statute which stipulates that "the creation of a framework for the achievement of full and fruitful coordination and cooperation between the PUIC Member Parliaments in international fora and organizations and meetings represents one of the Union's objectives,

Taking note of the resolutions of the PUIC and the Islamic Conferences of Foreign Ministers between the Member States of the OIC in order to adopt a unified stance in international fora which calls for coordination and consultation.

Recalling the resolutions adopted by the 9th, 10th and 11th Sessions of the PUIC Council on the establishment of a mechanism for regular consultation between Member Parliaments on the sidelines of meetings of international parliamentary organizations and fora in order to adopt a unified position concerning issues of common concern for the Islamic Ummah.

Considering the growing challenges facing the real image of Islam and also the common interests of the Islamic World in a world in which the tempo of interacting complexity and globalization is increasing that necessitates strengthening  cooperation and coordination among States of the PUIC Member Parliaments, including parliaments of these States in international fora,

Considering that the PUIC Member Parliaments constitute 45% of total votes of the Inter-Parliamentary Union which greatly facilitates the promotion of its goals in the Inter-Parliamentary Union.

Expressing its concern about attempts by some circles inside the Inter-Parliamentary Union to undermine the Islamic principles and values in one way or another.
 
1.     Commends holding consultative meetings on the sidelines of the IPU sessions and the role of the PUIC General Secretariat in this respect, and considers this an essential demand for realizing the common interests of the Ummah especially in the age of regional blocs and the growth of globalism

2.      Emphasizes the importance of urging the Parliaments of OIC Member States which do not enjoy membership of the PUIC to join immediately, in addition to their participation in other activities of the Union, and to actively take part in all meetings in order to consolidate the role of Islamic Parliamentary Group in the activities of international parliamentary organizations and fora, especially the Inter-parliamentary Union.

3.     Emphasizes that beside the other causes of the Islamic Ummah, the Palestinian issue and the question of Al-Quds Al Sharif as well as the defense of Islamic values and principles and combating obliteration of the image of Islam and Muslims should be the major issues on which Member Parliaments should take a unified stance in international fora.

4.     Invites all Member Parliaments to participate effectively in meetings of the Islamic Parliamentary Consultative Group in order to take its resolutions into consideration.

COOPERATION BETWEEN PUIC AND ICYF-DC


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Recalling resolution 3/32-C(a) on the “Islamic Conference Youth Forum for Dialogue and Cooperation” adopted by the Thirty-second Session of the Islamic Conference of Foreign Ministers held in Sana’a, Republic of Yemen, (21 - 23 Jumad Ul Awwal 1426H / 28 - 30 June 2005) which granted the ICYF-DC the status of institution affiliated to the OIC; as well as resolution 8/37-C adopted by the Thirty-seventh Session of the Islamic Conference of Foreign Ministers held in Dushanbe, Republic of Tajikistan, on 4 – 6 Jamad Ul Thani, 1431H, (18 – 21 May, 2010) which underlined the activities of this youth forum to promote the program on commemoration of human catastrophes which afflicted Muslim communities during the 20th Century, including partnership with ISESCO, and the PUIC, calling on the States of the Member Parliaments to participate affectively in this program;

Aimed at establishing horizontal cooperation between the international institutions functioning within the OIC domain in particular with a view of exercising coordinated efforts for successful implementation of the OIC 10-Year  Programme of Action adopted by the Third Extraordinary Session of the Islamic Summit Conference, held in Makkah Al-Mukarramah on 7-8 December 2005;

Reiterating the importance of undertaking all necessary measures in order to achieve harmonized and speedy development of youth in the PUIC and OIC countries in all areas, including elimination of poverty among youth, creation of opportunities to realize incomes for youth, strengthening technical capabilities of youth organizations, also strengthening the educational background and technical skills of youth in science, technology, culture, heritage, sustainable development and moral improvement; and assisting national institutions in strengthening human resource development among the youth; 

Desirous of promoting cooperation among the Member Parliaments in areas concerning youth issues;

1.    Welcomes cooperation between PUIC and ICYF-DC in all areas of interest as well as in the framework of the Memorandum of Understanding signed between the PUIC and ICYF-DC which reflects the various dimensions of cooperation between the two institutions.

2.    Welcomes also the proposal of ICYF-DC to further youth awareness of their parliamentary culture through the project of youth national parliaments and calls on the member parliaments and the PUIC General Secretariat to cooperate with this youth forum in implementing these programs.

3.    Supports the OIC Memorial Day initiative launched as a result of the OIC Inter-governmental Meeting of High-Level experts organized by ICYF-DC in partnership with ISESCO on 16-17 May 2008 in Istanbul (Turkey) aimed at commemoration of human-made catastrophes perpetrated against Muslim communities throughout the Twentieth century; as well as cultural programs and joint actions under the initiative designed to raise Muslim youth in the spirit of true solidarity and heighten awareness on threats and challenges to Islamic world;

4.    Welcomes Justice for Khojaly International Civil Awareness Campaign initiated by Mrs. Leyla Aliyeva, ICYF-DC Global Coordinator for Inter-Cultural Dialogue in the framework of the OIC Memorial Day Initiative and aimed at disseminating of historical truth on the mass massacre by Armenian forces of Azerbaijani civilians in the town of Khojaly, Azerbaijan on 26th February, 1992; and calls upon all Member Parliaments to give proper recognition to this crime against humanity and support the campaign on national and international levels;

JOINT ISLAMIC ACTION TO FACE THE EFFECTS OF
THE GLOBAL FINANCIAL CRISIS


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Following with deep concern the developments of the global economic and financial crisis with the accompanying slow down and recession of world economy and trade, the resulting negative effects on the economies of developing and Least-Developed Countries (LDCs), particularly the States of the PUIC Member Parliaments, and the extension of this slowdown on the sectors of real economy in terms of on production, exports, labor, investments, tourism and the remittances of workers abroad;

Expressing its growing concern about the resort of developed countries to protectionist measures and policies;

Urging States of the PUIC Member Parliaments to play a more effective role in international economic relations and participate in the international efforts aimed at ensuring world financial stability;

Aware of the fact that the frequency and gravity of the economic crises facing the world economy recently, including the food crisis, the energy crisis, and the financial crisis, among others, demonstrate the inadequacy of international decision-making structures in facing these crises and the need for radical reforms in order to deal with them more effectively in the future;

Emphasizing the recommendations of the Fifth World Islamic Economic Forum hosted by Jakarta on 1-4 March 2009;

1.     Expresses its concern about the long-term negative effects of the current economic and financial crisis on economic growth in the States in the PUIC Member Parliaments and the OIC Member States, on their national development plans, on their balance of payments, on their ability to have access to public and private financing, and on direct foreign investments.

2.     Stresses the importance of standing against the growing protectionist trends and of the necessity to have developed economies play a leading role in facing these measures and trends.

3.     Calls for allowing developing countries to have the necessary ‘policy space’ enabling them to implement incentive programs to energize their economies which are affected by the crisis.

4.     Insists on the necessity to reduce support measures harmful to trade and grant the products of developing and least-developed countries access to markets of developed countries.

5.     Hails the existing level of coordination between the delegations of the countries of the Islamic Group in different international arenas such as the United Nations, its organizations and its different organs on addressing the financial crisis.

6.     Commends the sustained support of the States of the PUIC Member Parliaments and the OIC Member States to their national financial institutions and the reinforcement of financial control and supervision, and encourages the ministers of finance and the governors of central banks and monetary institutions in the States of the PUIC Member Parliaments and the OIC Member States to increase coordination and connection among control organs in both the Organizations, and promoting the exchange of information on financial flows and risk assessments in different banking systems.

7.     Insists again on the necessity to have the Islamic World adequately represented in all deliberations on the impact of the global financial crisis, and on the need to expand the economic decision-making structures such as the G-20 to be more balanced and responsive to the demands of developing countries in general and States of the PUIC Member Parliaments and the OIC Member States in particular.

8.     Emphasizes the importance of setting up an efficient early-warning system within the IMF to avoid such crises in the future, and on the necessity to provide additional financial resources to the IMF and the World Bank in order to help developing and least-developed countries address the negative effects of the crisis.

9.     Urges the States of the PUIC Member Parliaments and the OIC Member States to strengthen their efforts for the achievement of the New Economic Partnership for the Ummah, and implement the programs aimed at promoting economic and commercial cooperation among these States.

VOLUNTARY CONTRIBUTIONS ALLOCATING TO THE ISLAMIC SOLIDARITY FUND TO FINANCE INTERDEPENDENCE AND SOLIDARITY ACTION AMONG ISLAMIC STATES IN CASE OF DISASTERS


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

1.     Requests Islamic States to honor their commitments to allocate voluntary contributions to the Islamic Solidarity Fund mentioned in the Declaration of the Third Session of the PUIC Conference, held on March 2004 in Dakar, Senegal, through:

a)     Inviting the PUIC Executive Committee to establish an organ to organize and administer the Fund.
b)     Coordinating among Islamic States at governmental and popular levels, in particular, among civil society organizations.
c)     Ensuring the exchange of information on prior “disaster forecasting” and dealing with them immediately when they strike and mobilize human and financial resources necessary to that effect.
d)     Requesting governments and parliaments of Islamic States to enact legislations that prevent accidents harmful to human beings and the environment for these and ensure defining the responsibilities of individuals and institutions from these calamities, in particular in the light of existing international conventions on issues such as the international convention on maritime transportation of nuclear materials and wastes, denounced by the international conference held in Copenhagen, in which some industrialized countries were held responsible of the pollution behind the world environmental disasters.

2.     Requests also to extend support to Central and East African countries (whole Horn of Africa), which suffer from famine and drought, and to include this in the disasters that should be covered by the Islamic Solidarity Fund when they happen.
3.      Invites Islamic States to expeditiously deliver urgent humanitarian assistance to areas and countries suffering from famine and drought.
4.     Encourages civil society organizations in the Islamic world to contribute to relief operations, to facilitate them and to protect them against harassment under various excuses such as the funding of terrorism of which they are innocent by the evidence of independent world societies.
5.     Invites contributions effectively to support the steadfastness of the Palestinian people who face an unjust blockade through offering contributions to the Palestine Support Fund under the supervision of the League of Arab States or by any other available means.

THE PROTECTION OF THE RIGHTS OF MIGRANT
WORKERS AND MEMBERS OF THEIR FAMILIES


The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Guided by the principles and objectives of PUIC Statue;

-    Determined to promote international cooperation in all political, economic, socio-cultural fields;

-    Taking note of article 13 of the Cairo Declaration on Human Rights in Islam (1990);

-    Being aware of the impact of the flows of migrant workers on States and people concerned, and desiring to establish rules which may contribute to the harmonization of the attitudes of the States through the acceptance of basic principles concerning the treatment of migrant workers and Members of their families;

-    Considering the situation vulnerability in which migrant workers and Members of their families frequently find themselves owing, among other things, to their absence from their State of origin and to the difficulties they may encounter arising from their presence in the State of employment;

-    Convinced that the rights of migrant workers and Members of their families have not been sufficiently recognized worldwide and therefore require appropriate international protection;

-    Taking into account the fact that migration is often the cause of serious problems for the Members of the families of migrant workers as well as for the workers themselves, in particular because of the scattering of the family;

-    Bearing in mind also that human problems involved in migration are even more serious in the case of international migration and convinced therefore that appropriate action should be encouraged in order to prevent smuggling and trafficking in migrant workers as well as to eliminate that phenomenon while at the same time assuring the protection of their fundamental human rights;

-    Encourages Parliaments of the PUIC Member States to promote the protection of migrant workers in their respective countries within the functions of parliaments in legislation, monitoring and budgeting

 SOLIDARITY WITH TUNISIA

The Council of the Parliamentary Union of the OIC Member States, in its 13th  Session, held in Abu Dhabi, State of the United Arab Emirates, on 13 Safar, 1432H corresponding to 18 January, 2011,

Stressing the right of the peoples in choosing what is appropriate for the management of its affairs without any intervention or trusteeship whatsoever,

Underlining the fact that civil rights constitute a main corner stone of human rights in civilized societies,

Expressing its profound keenness on Tunisia’s security, stability and the necessity of the return of calm and order all over its territories:

1.    Supports the responsible choice of the Tunisian people of the way it administers its country, and backs its right to the choice of its representatives.

2.    Appeals to all Tunisian forces and factions to maintain the highest degree of wisdom and self-restraint in order to protect the security of the country and its achievements.

3.    Requests the various foreign powers, international or regional, not to intervene in Tunisia’s internal affairs.
